1. Agreement to Terms
By accessing or using Certflo ("the Service"), operated by Mesquite Dev LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Certflo is a web-based compliance document management platform for motor carriers. The Service allows users to upload, track, and export Driver Qualification Files and related documents as described in 49 CFR Part 391. Certflo is not a legal compliance advisor, does not provide legal advice, and does not guarantee regulatory compliance.
3. Accounts and Access
You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account. Each workspace is intended for use by a single motor carrier entity and its authorized personnel.
4. Pricing and Payment
The Service is billed at $29 per driver per month with a 5-driver minimum. A 3-day free trial is available with a valid credit card. Billing begins automatically at the end of the trial unless you cancel. Up to 10 non-driver seats (branch manager, supervisor, dispatch) are included at no additional charge.
5. Cancellation
You may cancel your subscription at any time through the account billing page. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
6. Your Data
You retain ownership of all documents and data you upload to the Service. We do not sell, share, or use your data for purposes other than providing the Service. Upon account deletion, your data will be permanently removed within 30 days.
7. Acceptable Use
You agree not to use the Service to store, transmit, or process data that is unlawful, fraudulent, or harmful. You agree not to attempt to gain unauthorized access to other users' data, workspaces, or carrier records.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Mesquite Dev LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to fines, penalties, or regulatory actions resulting from compliance failures.
9. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes constitutes acceptance of the updated terms.
10. Governing Law
These terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
